Legal Services Request
  1. Instructions
    Kindly ensure the following:

    a. Prior to submitting a request for any of the legal services, listed below, obtain approval from the relevant Senior Manager (Executive Director/Dean/Senior Director or duly nominated and authorised officer).

    b. Complete the Legal Services Request Form in full as incomplete forms will not be considered

    c. The Legal Services Department reserves the right not to accept a request for legal services in instances where there is reason to believe that a request is in conflict with the University's interest or where the transaction has not been approved in accordance with the University's approval process.

  16. Approval
    (Before submitting your request for the required legal service, you must obtain approval from your Senior Manager (Executive Director/ Dean/ Senior Director or duly nominated and authorised officer)

  17. The requester must ensure that he or she follows up with the relevant senior line manager to ensure that the necessary approval is granted.

    In the event that the relevant senior manager does not approve or approval is not received within three (3) business days from date of submission of the Request for Legal Service Form, in the manner prescribed, the request will be deemed invalid and the request to the Legal Services Department will be cancelled with immediate effect.

  21. Confidentiality

    a. University information may be categorised under certain confidentiality and privacy classifications (which ranges from public to highly sensitive information) depending on the intended use and expected impact if disclosed.

    b. The University is bound by law, its own processes or contracts to protect the confidentiality of the information.

    c. CPUT may be required to disclose Personal Information by any Regulator or otherwise under applicable law

    d. Any communication received from the Legal Services Department should be forwarded within CPUT to relevant authorised personnel only and strictly on a need to know basis.

    e. No communication received from the Legal Services Department may be passed to any unauthorised person(s) or person(s) or entity(ies) outside CPUT without the written consent of the Legal Services Department.

  22. Consent Clause

    I warrant that any personal information provided by me was obtained in accordance with the provisions of the Protection of Personal Information Act, 2013 (Act No 4 of 2013), read with the Cape Peninsula University of Technology: Privacy Policy.

    I agree, understand, consent and irrevocably authorise the Legal Services Department of the Cape Peninsula University of Technology to use, process, verify and keep any information provided by me whether it be in paper and/or electronic format.

    I understand that the confidentiality requirements set out above will not apply to information that:

    a) is in the public domain;

    b) CPUT is required by law to disclose; or

    c) Is information received from a third party without restriction and without breach of a duty of confidentiality.
